Kentucky’s 1,473 public schools are operated by the state’s 171 school districts. Charter schools are not yet operating in the state due to an ongoing legal challenge to their constitutionality.
Charter schools were legally authorized in 2017 but lacked funding until the 2022-23 school year. Charter schools operate under a contract with an authorizer, which is a local school board of education or mayors. An applicant may appeal a decision to the State Board of Education, which may act as a co-authorizer of a charter school for up to three years. A charter school is considered a school of residence within a local school district and is not its own LEA.
Charter schools have significant autonomy and are exempt from all statutes and administrative regulations applicable to the State Board of Education, a local school district, or a school, except the public charter school shall adhere to the same health, safety, civil rights, and disability rights requirements as are applied to all public schools.
